Transport Scotland’s Pass Collect app - Terms and Conditions
Who we are
Transport Scotland, an executive agency of the Scottish Government, is the operator of the ‘Transport Scot Pass Collect’ app.
Transport Scotland is based in 177 Bothwell Street, Blythswood New Town, Glasgow, G2 7ER.
What these terms cover
These Terms and Conditions govern the use of the Transport Scot Pass Collect app. By downloading or using the app, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
Please read these Terms and Conditions carefully before proceeding.
For the purposes of these Terms and Conditions, the term ‘User’ refers to any individual who downloads and/or uses the app.
Our right to modify these terms and conditions
Transport Scotland reserves the right to revise these Terms and Conditions at any time. Such revisions may be necessary to reflect changes in applicable laws, regulatory requirements, or modifications to the functionality or features of the app.
It is the responsibility of the User to review these Terms and Conditions periodically to ensure awareness of any updates. Continued use of the app following the publication of any changes shall constitute the User’s acceptance of those changes.
These Terms and Conditions were last reviewed on 26 June 2025.
Our terms
Who can use the app
The app is intended only for private, domestic, and transport operational use. It must not be used for any commercial or profit-generating purposes.
The app is designed for use by people residing in Scotland only.
Operating system requirements
The app is compatible with smart mobile phones that are compatible with NFC (Near Field Communication) functionality.
Limitations to the app
While Transport Scotland makes reasonable efforts to ensure that the app operates correctly, this cannot be guaranteed at all times.
The app does not provide professional advice, and any information obtained through its use should not be relied upon as a substitute for professional or specialist guidance. Users are advised to seek appropriate advice before taking, or refraining from, any action based on information provided by the app.
Although we endeavour to keep the information within the app accurate and up to date, Transport Scotland makes no representations, warranties, or guarantees (express or implied) regarding the accuracy or currency of such information.
Our responsibility for foreseeable loss or damage caused by us
If Transport Scotland fails to comply with these Terms and Conditions, we will be liable for any loss or damage you suffer that is a foreseeable consequence of our breach or our failure to exercise reasonable care and skill.
Loss or damage is considered foreseeable if it is either an obvious consequence of our breach or if, at the time you accepted these Terms and Conditions, both you and we knew that such loss or damage might occur.
We shall not be liable for any loss or damage that is not foreseeable.
Our responsibility for damage to your property
We do not guarantee that the app will be secure or free from bugs, viruses, or other harmful components.
If the digital content we provide is defective and causes damage to your device or to other digital content owned by you, we may either repair the damage or offer appropriate compensation.
However, we will not be liable for any damage that:
(a) could have been avoided by following our advice to install an update provided to you free of charge; or
(b) results from your failure to comply with these Terms and Conditions, including failure to correctly follow installation instructions or to ensure that your device meets the minimum system requirements
Our responsibility for business losses
Transport Scotland is not liable for business losses. If you use the app for any commercial or business purposes, Transport Scotland shall not be responsible for any loss of profit, loss of business, business interruption, or loss of business opportunity arising from such use.
Our responsibility for events outside our control
Transport Scotland is not liable for events outside our control. If the availability or support of the app is delayed due to circumstances beyond our control, we will communicate this via our website. While we are not responsible for delays caused by such events, you may choose to stop using the app at any time if the delay is likely to be significant.
Liability not excluded where unlawful
Transport Scotland does not, and cannot, exclude or limit its liability to you where doing so would be unlawful. This includes liability for death or personal injury caused by our negligence, or the negligence of our employees, agents, or subcontractors, as well as liability for fraud or fraudulent misrepresentation.
Changes to the app
We may occasionally update the app automatically to improve performance, enhance features, ensure compatibility with operating system updates, or address security vulnerabilities. We may also request that you install updates manually. If you choose not to install these updates or disable automatic updates, the app may not function properly, may become insecure, or you may be unable to continue using it.
Suspension or withdrawal of the app
The app is provided free of charge therefore we do not guarantee its continuous availability or uninterrupted operation. We may suspend, withdraw, or limit access to all or part of the app for operational or policy-related reasons. Where possible, we will provide reasonable notice of any such changes.
Links within the app
The app may include links to external websites that are not under the control of Transport Scotland. These links are provided solely for user convenience. Transport Scotland accepts no responsibility for the content, reliability, or availability of these external sites, nor does it endorse any views, organisations, or individuals associated with them. We do not guarantee that these links will function at all times and have not reviewed or approved the content or privacy practices of the linked websites. Users should exercise their own judgment when deciding to access or use any third-party sites.
Using the app on someone else’s device
If you download the app onto a device that you do not own, you must first obtain the owner's permission. Regardless of ownership, you are responsible for complying with these Terms and Conditions, whether or not you own the phone.
Delayed enforcement does not waive our rights
Any delay or failure by Transport Scotland to exercise any right or remedy under these Terms and Conditions shall not constitute a waiver of such right or remedy, nor shall it prevent or restrict the further exercise of such right or remedy, unless expressly stated by Transport Scotland in writing
Acceptable use restrictions
You must not:
- a) Use the app in any unlawful way, for any unlawful purpose, or in a manner that conflicts with these Terms and Conditions. This includes engaging in fraudulent or malicious activities, such as hacking or introducing viruses or harmful code.
- b) Infringe upon our intellectual property rights or those of any third party when using the app.
- c) Transmit any content that is defamatory, offensive, or otherwise inappropriate through the app.
- d) Use the app in a way that could damage, disable, overload, impair, or compromise our systems or security, or interfere with other users.
- e) Copy the app, except as necessary for normal use or for backup and operational security purposes.
- f) Translate, adapt, modify, or merge the app, or allow it to be combined with other software, except as required for permitted use on your devices.
- g) Disassemble, decompile, reverse engineer, or create derivative works based on the app, unless such actions are permitted by law.
Intellectual property rights
Unless expressly stated otherwise in writing by Transport Scotland, all copyright and intellectual property rights (including, but not limited to, design rights, trademarks, and patents) in the materials on the app remain the property of Transport Scotland or its licensors.
Content provided by Transport Scotland and/or its licensors, such as text and images, may not be printed, copied, reproduced, republished, downloaded, posted, displayed, modified, reused, broadcast, or transmitted in any form, except for personal, non-commercial use. Any other use requires prior written permission.
Ending your use of the app and what it means
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers typically have a statutory right to withdraw from online contracts for digital content within 14 days of the contract being formed. However, this right does not apply to your use of the app. By downloading the app, you consent to the immediate start of the contract and acknowledge that you lose your right to withdraw once the download begins.
However, you may stop using the app at any time and delete it from your device. Once the app is uninstalled, the contract between you and Transport Scotland, as outlined in these Terms and Conditions, will end. Upon deletion, all rights granted to you under these Terms and Conditions will also cease
Termination of rights for breach of terms
We may terminate your rights to use the app at any time if you breach these Terms and Conditions. If the issue can be resolved, we will give you a reasonable opportunity to correct it.
If your rights to use the app are terminated:
- a) You must immediately cease all activities permitted under these Terms and Conditions, including use of the app and any related services.
- b) You must delete or remove the app from all devices in your possession and destroy any copies you have. You may be required to confirm that this has been done.
- c) We may remotely access your devices to remove the app and disable access to associated services.
What happens if part of this contract is found unlawful
Each paragraph of these Terms and Conditions operates independently. If any paragraph is found to be unlawful by a court or relevant authority, the remaining provisions will continue to be valid and enforceable
App store’s terms also apply
When you download or use the app, you may also be subject to the terms of use and policies of the app store from which the app is obtained (such as the Google Play Store or Apple App Store). It is your responsibility to review those terms and policies carefully.
Your access to and use of the app is primarily governed by these Terms and Conditions, except where the terms and policies of the relevant app store expressly state otherwise.

Privacy policy
The app does not collect or process any personal data from users or other individuals. For general information on how Transport Scotland handles personal data related to concessionary travel and smart ticketing, please refer to our Privacy Policy.
Law and jurisdiction
These Terms and Conditions, including their subject matter and formation, are governed by the laws of Scotland. Any disputes arising between the User and Transport Scotland in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Scottish courts.
Entire agreement
These Terms and Conditions, along with any other terms expressly referenced within them, represent the entire agreement between Transport Scotland and the User concerning the subject matter addressed.
