Compulsory Purchase Order

Roads (Scotland) Act 1984 and the Acquisition Of Land (Authorisation Procedure) (Scotland) Act 1947 - The A9 Trunk Road (Pass of Birnam to Tay Crossing) (Compulsory Purchase) Order 202[ ]

Notice is hereby given that the Scottish Ministers in exercise of the powers conferred by the above mentioned Acts, on the Thirtieth day of May Two Thousand and Twenty Five prepared the above mentioned draft Compulsory Purchase Order authorising them to purchase compulsorily the land described in the Schedule hereto, for the purpose of improving and constructing new lengths of the M9/A9 Edinburgh – Stirling – Thurso Trunk Road between Pass of Birnam to Tay Crossing in the County of Perthshire by widening and reconstructing the existing single carriageway to form a new dual carriageway section.

The Order is about to be made and comes into operation only if made. If the Order is made, a conveyance registered in implement of the Order may vary or extinguish rights to enforce real burdens and servitudes affecting the land.

A copy of the Orders and of the relevant plans referred to therein may be inspected, free of charge, during normal opening hours from 30 May 2025 to 25 July 2025 at the following locations:

Open Space Notice

The Acquisition Of Land (Authorisation Procedure) (Scotland) Act 1947 - The A9 Trunk Road (Pass of Birnam to Tay Crossing) (Compulsory Purchase) Order 202[ ]

The A9 Trunk Road (Pass of Birnam to Tay Crossing) Compulsory Purchase Order 202[ ], which has been prepared in draft and notice published on the thirtieth day of May Two Thousand and Twenty Five, includes the land described in the Schedule to this Notice.

The land is to be acquired for the purpose of improving and constructing new lengths of road in relation to the M9/A9 Edinburgh – Stirling – Thurso Trunk Road between the Pass of Birnam and Tay Crossing in the County of Perthshire by widening and reconstructing the existing single carriageway to form a new dual carriageway section.

The land to be acquired forms part of an open space.

Notice is hereby given that the Scottish Ministers, in exercise of the powers conferred on them by paragraph 11 of Part III of the First Schedule to the Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947, propose to give a certificate that that they are satisfied that this land is required for the widening of an existing public road within the meaning of the Roads (Scotland) Act 1984 and that the giving in exchange of other land is unnecessary in the interests of the public.

The giving of exchange land is considered unnecessary in the interests of the public as sufficient other suitable land is, and part of the open space land being acquired will be, available to the public for access and equally advantageous use subsequent to completion of the works to widening of the public road.

A map showing the land to which the proposed certificate relates may be inspected free of charge and during their normal opening hours, from 30 May 2025 to 25 July 2025 at the following locations:

  • Birnam Arts, Station Road, Birnam, Dunkeld, PH8 0DS
  • Transport Scotland, 177 Bothwell Street, Glasgow, G2 7ER

Please note that normal opening hours might vary during this period.

Any objections or representations in relation to the proposed certificate or Order must be made in writing stating the title of the Order and the grounds of objection and addressed to the Director of Major Projects, Transport Scotland, 177 Bothwell Street, Glasgow, G2 7ER. Any such notice must be received on or before 25 July 2025.

The Scottish Ministers may, if they consider it expedient, hold a public local inquiry, after having regard to any representations and objections made.
