The A702 Trunk Road (Biggar) (Temporary Prohibition on Use of Road) (No. 2) Order 2025

The Scottish Ministers hereby give notice that they have made the above Order under sections 2(1) and (2), 4(1), 16A and 124(1)(d), and paragraph 27(1) of schedule 9, of the Road Traffic Regulation Act 1984 which will have the effect of temporarily prohibiting vehicles on that length of the A702 Edinburgh – Abington Trunk Road from its junction with Station Road, Biggar, in a generally north-easterly direction to its junction with the B7016 Broughton Road, a distance of 740 metres or thereby.

This Order also revokes the A702 Trunk Road (Biggar) (Temporary Prohibition on Use of Road) Order 2025 (“the original order”) which was made on 15 December 2025 and was due to come into force on 31 December 2025. The original order was intended to put in place the same prohibitions imposed by this Order, however, an error in the cessation date in article 1 was identified after the original order was made. This Order therefore revokes the original order and puts in place the necessary prohibitions on the use of the trunk road.

This Order, which is required to facilitate the Biggar Hogmanay Bonfire and to enable members of the public to participate in this event, will be in operation from 31st December 2025 until 2nd January 2026 and will only have effect in relation to such part or parts of the length of road as is indicated by the appropriate traffic signs.

This Order does not apply to vehicles while being used in an emergency for fire brigade, ambulance, police or coastguard purposes or a vehicle being used for facilitating the holding of the relevant event.

Statement of Compatibility

In accordance with section 23(2) of the United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 (the Act), the Scottish Ministers certify that, in their view, the A702 Trunk Road (Biggar) (Temporary Prohibition on Use of Road) (No. 2) Order 2025 is compatible with the UNCRC requirements as defined by section 1(2) of the Act.

The proposal is an order with the title “The A702 Trunk Road (Biggar) (Temporary Prohibition on Use of Road) (No. 2) Order 2025’’. This order allows part of the A702 trunk road to be closed for a period of time on 31st December 2025 and 1st January 2026, to facilitate a torchlight procession and lighting of the Hogmanay bonfire, and to allow members of the public to participate in the event.

This Order also revokes the A702 Trunk Road (Biggar) (Temporary Prohibition on Use of Road) Order 2025 (“the original order”) which was made on 15 December 2025 and was due to come into force on 31 December 2025. This Order therefore revokes the original order and puts in place the necessary prohibitions on the use of the trunk road.

It is anticipated that the road will only be closed from 1900 hours on 31st December 2025 until 0400 hours on 1st January 2026. The temporary closure will only have effect when the type of traffic sign specified in the order is displayed. This means that no person may use, or authorise the use of, any vehicle on that specific length of road during that period. The only exceptions are for emergency vehicles and vehicles involved in holding the relevant event. The order will not prevent pedestrians from using that length of road at any time.

As this closure is from early evening until early morning no facilities dedicated to children such as schools or nurseries will be impacted. Emergency vehicles will not be impacted during this closure and will be able to access the road during the closure. The closure is to maintain the safety of members of the public participating in the Biggar Hogmanay events. The closure will not restrict pedestrians at any time.
