The A82 Trunk Road (Balchraggan) (Temporary Clearway) Order 2025
The Scottish Ministers give notice that they have made the above Order under sections 2(1) and 2, 4(1) and 14(1)(b) and (4) of the Road Traffic Regulation Act 1984, which will have effect of imposing a restriction on stopping on that length of the A82 Dalnottar – Inverness Trunk Road from a point 3.12 kilometres or thereby north-east of the extended centreline of the A831, generally in a north easterly direction to a point 970 metres or thereby in a north easterly direction of the extended centreline of the C1072 Abriachan to Foxhole Road, a distance of 6.97 kilometres or thereby.
The Order, which is required because of the likelihood of danger to the public will be in operation from 30th June until 30th September 2025 and will only have effect in relation to such part or parts of the length of road as is indicated by the appropriate traffic signs.
No restriction imposed by this Order applies to a person causing or permitting a vehicle to stop —
- in any case where the person in control of the vehicle—
- is required by law to stop,
- is obliged to stop in order to avoid an accident,
- is prevented from proceeding by circumstances outwith their control and it is not reasonably practicable for them to drive or move the vehicle,
- when the vehicle is—
- being used in an emergency for fire brigade, ambulance, police or coastguard purposes,
- being used for the purpose of delivering letters, parcels, packets or other articles to premises situated on or adjacent to the length of road specified in the schedule,
- being used by or on behalf of a local authority for the purpose of the collection of household refuse from premises situated on or adjacent to the length of road specified in the schedule,
- a public service vehicle as defined by section 1 of the Public Passenger Vehicles Act 1981 providing a local service as defined in section 2 of the Transport Act 1985,
- a taxi or private hire car as defined by section 23(1) of the Civic Government (Scotland) Act 1982 stopping for the purpose of taking up or setting down passengers,
- for so long as may be necessary to enable the vehicle to be used in connection with—
- any building operation or demolition being carried out adjacent to the length of road specified in the schedule,
- the removal of any obstruction or potential obstruction to traffic on the length of road specified in the schedule,
- the maintenance, improvement or reconstruction of the length of road specified in the schedule,
- the laying, erection, placing, maintenance, testing, alteration, repair or removal of any structure, works or apparatus in, on, under, over or adjacent to the length of road specified in the schedule.
Alternative routes
An alternative route is not required.

UN Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 Compatibility Consideration and Narration of Statement of Compatibility
The Scottish Ministers have made the following statement regarding children’s rights.
“In accordance with section 23(2) of the United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 (the Act), the Scottish Ministers certify that, in their view, The A82 Trunk Road (Balchraggan) (Temporary Clearway) Order 2025, is compatible with the UNCRC requirements as defined by section 1(2) of the Act.”
