The A84 Trunk Road (Callander) (Temporary Prohibition on Waiting, Loading and Unloading) Order 2025

The Scottish Ministers give notice that they have made the above Order under sections 2(1) and (2), 4(1) and 14(1)(a) and (4) of the Road Traffic Regulation Act 1984, temporarily prohibiting traffic on that length of the A84/A85 Stirling - Crianlarich Trunk Road at Main Street, Callander from a point at its northerly junction with the Ancaster Square and in a general north westwards direction to a point at its junction with Station Road a distance of approximately 216 metres.

The Order, which is required to facilitate utility works in the carriageway will be in operation from 13th January 2025 until 21st January 2025. Restrictions on the trunk road will be in operation between 24 hours a day as indicated by the appropriate traffic signs.

The Order does not apply to vehicles while being used in an emergency for fire service, coastguard, ambulance or police purposes or to acts done with the permission or upon the direction of a police constable in uniform, or a vehicle being used for carrying out the works.

UN Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 Compatibility Consideration and Narration of Statement of Compatibility

The Scottish Ministers have made the following statement regarding children’s rights.

In accordance with section 23(2) of the United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 (the Act), the Scottish Ministers certify that, in their view, The A84 Trunk Road (Callander) (Temporary Prohibition on Waiting, Loading and Unloading) Order 2025 is compatible with the UNCRC requirements as defined by section 1(2) of the Act.

The proposal is an order with the title “The A84 Trunk Road (Callander) (Temporary Prohibition of Waiting, Loading and Unloading) Order 2025. This order prohibits parking, loading, unloading or waiting of any vehicle on the length of road described in the schedule of the order between 13 January 2025 and 20 January 2025. This prohibition will allow manhole cover to be repaired, these are not emergency works, they are to repair a manhole in the road. These works will take place under the specified length of road described in the order so will need to prohibit parking, waiting, loading and unloading to allow for works to take place. Emergency vehicles and vehicles involved in carrying out the works will not be affected by the prohibition.

  1. With reference given to the requirements of the UNCRC (Incorporation) (Scotland) Act 2024 (Annex 1), which aspects of the proposal are relevant to children’s rights? (Guidance Section 3.2, pages 20-22).

During the temporary restriction of parking, waiting, loading/unloading of this section of road there will be no impact on children and young people’s ability to access:

  • school
  • childcare facilities
  • higher or further education institutions
  • hospitals
  • places used for recreational activity
  • places of worship

as none of these facilities affected by the restrictions of the order on this area of road. There are suitable alternative areas nearby for parking, waiting, loading or unloading. Therefore this order will not impact articles 14, 24, 28 or 31. Therefore we do not see any potentially negative impacts to children and young people as a result of this order.

As the order is to maintain the pipes as opposed to improvement works or emergency works to ensure negative impacts do not occur, we do not see any positive impacts to children and young people as a result of the works so would determine no impact overall.

Mapping routes show that there are no facilities unable to be accessed or having restricted access by children and young people or their families, carers, representatives etc. as a result of the proposal. Therefore, we can rule out that this order has the potential to restrict access and therefore potentially impact on articles 14, 24, 28 and 31.

Mapping evidences showed that no facilities would have reduced access as a result of this order so allowed us to rule out impact to articles associated with this such as articles 14, 24, 28 and 31, as these were the only potential impacts identified which were subsequently ruled out through the evidence, no impact was assessed through this process.
