Extinguishment of Public Rights of Way Order

The A9 Trunk Road (Pass of Birnam to Tay Crossing) (Extinguishment of Public Rights of Way) Order 202[ ]

Notice is hereby given that the Scottish Ministers, in exercise of the powers conferred on them by section 3 of the Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947, propose to make the above-mentioned Order extinguishing certain public rights of way in the County of Perthshire and providing alternative public rights of way, as described in the Schedule hereto.

Copies of the Order and relevant plans may be inspected, free of charge, during normal opening hours from 30 May 2025 to 25 July 2025 at:-

  • Birnam Arts, Station Road, Birnam, Dunkeld, PH8 0DS
  • Transport Scotland, 177 Bothwell Street, Glasgow, G2 7ER

Please note that normal opening hours might vary during this period.

Any person may object to the making of this Order by notice in writing to the Director of Major Projects, Transport Scotland, 177 Bothwell Street, Glasgow, G2 7ER, stating the title of the Order, the objector’s names and address and the grounds of objection. Any such notice must be received on or before 25 July 2025.

Part 1

Public Rights of Way to be Extinguished
  1. A length of the existing public right of way, not being a vehicular right of way, which crosses the existing M9/A9 Trunk Road, in a generally north-easterly direction, leading to Perth Road, Dunkeld.
  2. A length of the existing public right of way, not being a vehicular right of way, heading in a generally north-westerly direction to the north-west of Dunkeld Wastewater Treatment Works, Dunkeld.
  3. A length of the existing public right of way, not being a vehicular right of way, heading in a generally south-westerly direction from the unnamed track to the south-west of the Dunkeld and Birnam Sports and Leisure Hub and crossing under the existing A9 Trunk Road.
  4. A length of the existing public right of way, not being a vehicular right of way, heading in a generally northerly direction from the east of the River Braan to the south-west of the Dunkeld and Birnam Sports and Leisure Hub.

Part 2

Alternative Rights of Way to be Provided
  1. A public right of way heading in a generally north, north-westerly direction from the B897 Bankfoot – Birnam Road to join where the existing right of way is being stopped up, south-west of the existing A9 Trunk Road.
  2. A public right of way heading in a generally north-westerly direction, to join where the existing right of way is being stopped up, before Perth Road, Dunkeld.
  3. A public right of way, from where the existing right of way is being stopped up, crossing the M9/A9 Trunk Road, in a generally south-westerly direction, to the Birnam – Inver Road (C504).
  4. A public right of way, from where the existing right of way is being stopped up, heading in a generally northerly direction, parallel to the River Braan.
